Differences between Mechanics Liens & Judgments

There is difference between mechanics liens and Judgments in the state of NJ.  

- Mechanics liens may only be placed on property by contractors, so they are unavailable to other industries.

  • There is a filing deadline of 90 days for commercial properties and 120 for residential properties.
  • This is generally from the last date worked or materials provided.
  • The lien is good for 1 year unless extended, and the time to enforce the lien is limited.

- A Judgment is effective for 20 years and can be renewed for another 20 years.

  • Judgments are available to all creditors, not just contractors.
  • There are a variety of ways that a Judgment can be enforced, including liens on property, wage garnishments and levies on bank accounts.
